nLPD (Swiss data protection)

The Swiss Federal Act on Data Protection: when it applies, what is the same for every brand of the platform, and where to ask for the contract documents.

The Federal Act on Data Protection (FADP; nLPD in Italian, nDSG in German) has been in force in Switzerland since 1 September 2023. It applies to the processing of personal data in Switzerland, and to processing abroad that has effects in Switzerland.

What applies to ITS INCOM AI

ITS INCOM AI keeps its data in Switzerland and is run by Internet One Srl for the ITS INCOM Foundation. Three facts are the same for every brand of the platform:

  • The control plane is in Switzerland and receives no personal data: only hourly numbers, with no users, keys, texts or IP addresses.
  • A zone in Switzerland means processing in Switzerland. If your key uses a zone in Switzerland, your requests are processed there, whatever the brand. The zones of every model, with their country, are in the catalogue.
  • Between Switzerland and the EU, personal data can move without further formalities: the European Commission recognises Switzerland as adequate, and Switzerland recognises the states of the EU.
